Quick Answer

A DUI arrest in Lake Havasu City is prosecuted under Arizona law even if you live in California, Nevada, or another state, and the case stays in a Mohave County court long after you drive home. Your home state licensing agency can also act on an Arizona conviction, so the consequences follow you across the state line.

What Happens If an Out of State Driver Gets a DUI in Lake Havasu?

You drove to Lake Havasu for the weekend. You are driving home Monday with a court date, a piece of paper where your license used to be, and a very specific fear: what happens when I get back to California, or Nevada, or Utah?

Here is the honest answer. Arizona cannot take your home state license. Arizona can only suspend your privilege to drive in Arizona. But Arizona will report the conviction to your home state through the Driver License Compact, and your home state will then treat the Arizona DUI as though it happened on your own street. That is where the real damage occurs, and it happens automatically unless the Arizona case is handled correctly.

Matthew Lopez Law represents out-of-state drivers charged with DUI in Lake Havasu City and throughout Mohave County. Contact our firm for a confidential consultation.

The 15-Day Deadline Nobody Tells You About

When you were arrested, the officer took your license and gave you a temporary permit. That paper started a clock.

You have 15 days from the date of service to request a hearing with the Arizona Motor Vehicle Division. Miss it and the suspension takes effect automatically, with no hearing, no argument, and no review. This applies to out-of-state drivers exactly as it applies to Arizona residents.

Most visitors miss this deadline. They are focused on the criminal court date printed on their paperwork, and they do not realize the MVD case is a separate proceeding running on its own schedule. By the time they hire a lawyer for the court date, the license question has already been decided against them.

How the Driver License Compact Works

Arizona is a member of the Driver License Compact, an agreement among nearly every state to share driving records and honor each other’s actions. Under it:

  • The Arizona MVD reports your DUI conviction to your home state’s licensing agency
  • Your home state applies its own law to the Arizona conviction, as though the offense occurred there
  • Suspensions and revocations imposed by one member state must be honored by the others

The five states that are not compact members are Georgia, Massachusetts, Michigan, Tennessee, and Wisconsin. Drivers from those states still face reporting through other national databases, so the practical protection is limited.

For the Californians and Nevadans who make up most of Lake Havasu’s visitors, both states are compact members. Your home DMV will learn about this.

Arizona’s DUI Laws Are Probably Harsher Than Home

Visitors are often shocked by Arizona’s penalties, because they are among the strictest in the country. Even a first offense carries mandatory jail.

Charge BAC First-Offense Minimum
Standard DUI 0.08 to 0.149 10 consecutive days jail, 9 suspendable
Extreme DUI 0.15 to 0.199 30 consecutive days jail, suspendable to 9 with interlock
Super Extreme DUI 0.20 or above 45 consecutive days jail, suspendable to 14 with interlock

Every level also brings mandatory alcohol screening, treatment, an ignition interlock requirement, and fines and assessments that typically run past $1,600. A visitor from a state where a first DUI means a fine and a class is facing something categorically different here.

Do You Have to Come Back to Arizona?

Often, no. In many misdemeanor DUI cases, defense counsel can appear on your behalf and handle the routine court dates, which means no repeated 300-mile drives or flights back to Mohave County. Whether appearances can be waived depends on the specific court and the posture of the case, and some proceedings do require you personally.

Felony charges are different. Aggravated DUI cases generally require the defendant to appear.

What you cannot do is ignore it. Failing to appear produces a bench warrant. Misdemeanor warrants often stay within Arizona, but they surface at traffic stops, at airports, and during background checks, and they never expire. Felony warrants cross state lines.

Where Your Lake Havasu Case Will Be Heard

Lake Havasu City is unusual in that the municipal court, the justice court, and the superior court all sit in the same location. Which one hears your case depends on where the stop happened and what you are charged with.

Court Handles Prosecuted By
Lake Havasu City Municipal Court Offenses within city limits, up to Class 1 misdemeanors Lake Havasu City Prosecutor
Lake Havasu Justice Court Offenses inside and outside city limits, including State Route 95, Desert Hills, and the Havasu National Wildlife Refuge Mohave County Attorney’s Office
Mohave County Superior Court Felonies, including aggravated DUI Mohave County Attorney’s Office

Note that the felony court is Mohave County Superior Court, which maintains a Lake Havasu City location along with Kingman and Bullhead City. Lake Havasu City is in Mohave County; there is no separate county courthouse for the city.

Where you were pulled over genuinely matters. A stop on McCulloch Boulevard inside city limits and a stop on Highway 95 outside them go to different courts with different prosecutors and different plea practices.

Who Pulled You Over

Three agencies enforce DUI around Lake Havasu, and which one made the stop shapes the case:

  • Lake Havasu City Police Department patrols within the city
  • Mohave County Sheriff’s Office covers outlying and unincorporated areas
  • Arizona Department of Public Safety works the highway corridors toward Kingman and Bullhead City

Enforcement intensifies over spring break, Memorial Day, the Fourth of July, and Labor Day, when the visitor population multiplies. That surge means saturation patrols staffed by officers working extended hours, and it produces the procedural errors, chain of custody gaps, and multi-agency handoff problems that make suppression motions viable.

If your arrest happened on the water rather than the road, the charge is Operating Under the Influence, enforced by Arizona Game and Fish, and it carries a different set of rules including the requirement that the vessel was underway.

What an Out-of-State Defense Actually Involves

Protecting the MVD case first. Requesting the hearing within 15 days preserves your Arizona driving privilege and delays the report that triggers home-state action.

Attacking the stop and the testing. Reasonable suspicion, field sobriety administration, breath machine calibration, the observation period, blood draw procedure, and chain of custody are all reviewed the same way they would be for a resident.

Understanding home-state consequences before pleading. This is where out-of-state cases differ most. A plea that looks reasonable in Arizona can trigger a far worse result at home, depending on how your state treats the specific offense. That analysis has to happen before the plea, not after.

Reduction strategy. Where the evidence has weaknesses, reduction to reckless driving under ARS 28-693 eliminates the mandatory DUI jail and interlock, and it is reported very differently to your home state.

An Arizona DUI follows you home. The 15-day MVD window, the choice of court, and the terms of any plea all shape what your home state does with the report, and those decisions get made in the first weeks. Being 300 miles away does not have to mean handling this alone.
