Creating a wake in a no wake zone is a misdemeanor. Misdemeanors carry a maximum fine of $2500 plus 83% surcharge and six months in jail. While it is unlikely that you are going to get six months in jail or even any jail at all, you surely do not want to have a misdemeanor criminal conviction on your record. In some states, after a certain amount of time has passed, a criminal conviction will fall off your record. Unfortunately, Arizona is not one of the states. Once you’re charged and convicted of a criminal misdemeanor, the misdemeanor will forever be on your record.
