If the police have reasonable suspicion that you are under 21 and have consumed alcohol, they have the legal authority to approach you for further investigation. If your breath smells like alcohol or are showing any signs or symptoms of alcohol consumption, they can issue a citation – even if you did not blow into a breathalyzer.

If you you are under 21 and approached by police, and you have been drinking, I suggest just handing them your driver’s license (by law you have to) and do not answer any of their questions. When I say don’t answer their questions, I mean none of their questions. As soon as you open your mouth, they will say you smell like alcohol. If they want to proceed with a breathalyzer, do not blow.
