Arizona has some of the strictest DUI laws in the country. Under these laws, if you operate a motor vehicle with a blood alcohol concentration (BAC) of .08% or higher or while impaired to the slightest degree by drugs and/or alcohol, you could be charged with driving under the influence (DUI). Notably, if you are under the age of 21, hold a commercial driver’s license, or are operating a taxi service, the legal limit is 0% (under 21) to .04%.
A DUI conviction comes with severe consequences. The exact penalty depends on your level of intoxication and criminal history, but all DUIs will result in a mandatory minimum jail sentence and fines. Potential consequences include:
- First DUI conviction: at least 10 days in jail and a $1,250 fine, plus a 90-day license suspension and 1-year requirement to install an ignition interlock device (IID). These penalties increase for an “extreme DUI” (BAC of .15% to .199%) to a minimum of 30 days in jail and a fine of $3,000, plus a 1-year license suspension and 1-year IID requirement. For a “super extreme DUI” (BAC of at least .20%), the penalty goes up again to at least 45 days in jail and $3,250 in fines, plus a 1-year license suspension and 1-year IID requirement.
- Second or third DUI conviction: at least 90 days in jail and a $2,500 fine, plus a 1-year license suspension and 1-year IID requirement. For an extreme DUI, the penalties are a minimum of 120 days in jail and a fine of $3,250, plus a 1-year license suspension and 1-year IID requirement. For a super extreme DUI, the penalty increases to at least 180 days in jail and $4,250 in fines, plus a 1-year license suspension and 1-year IID requirement.
