I had two hearings in Gila Bend this morning for Excessive Speeding. Gila Bend is one of the biggest speed traps in all of Arizona. People either coming from or going to San Diego have been used to traveling 75 miles per hour for miles and miles. All of a sudden, they come to the tiny town of Gila Bend and don’t realize the speed limit drops significantly. A person can be charged with excessive speeding, otherwise known as criminal speeding, if they are traveling more than 20 miles per hour over the posted speed limit or more than 85 miles per hour. Excessive Speeding is a class 3 misdemeanor that carries a maximum penalty of 30 days in jail, $500 fine plus 83% surcharge, and probation. More importantly, this is a criminal conviction that will forever appear on your record. My office receives calls on a regular basis from people who simply do not understand the severity of this charge. I have represented people where the prosecutor was determined to send them to jail for their excessive speeding conviction. After establishing an effective defense, and pleading with the prosecutor, I was able to keep them out of jail. IF YOU HAVE BEEN CHARGED WITH EXCESSIVE SPEEDING, THERE IS A CHANCE YOU WILL GO TO JAIL.
