I don’t understand why someone who travels a little too fast should be facing a criminal charge. Modern cars have so much technology built into them that it is reasonable for someone to be traveling faster than they realize because of the smooth ride. On a personal level, I do it all the time. I’m listening to the radio, thinking about something else, then all of a sudden, I’m driving 85 miles per hour on the 101. Criminal Speeding is a misdemeanor, just like a DUI is a misdemeanor. If convicted of the charge, you will have to disclose it on school or employment applications.
Can I have My Criminal Speeding Conviction Expunged?
Unlike most states, Arizona does not expunge criminal convictions. The next best thing that you can have done in Arizona is to have your criminal conviction set aside. The law that gives judges authority to set aside criminal convictions, excludes criminal convictions that fall under chapter 28 of the Arizona Statutes. Because criminal speeding falls under chapter 28, your conviction cannot be set aside.
