What are extreme and aggravated DUIs?

When pulled over under suspicion of a DUI, there are various penalties you may face based on the type of DUI. DUI charges occur when you drive with a blood alcohol concentration of 0.08% and above.

According to the Arizona Department of Transportation, you may face DUI charges when you have any alcohol in your system if under the age of 21. You may face extreme DUI charges or aggravated DUI charges in some circumstances.

What is an extreme DUI?

An extreme DUI has everything to do with how high your blood alcohol concentration is. If you have a BAC of 0.15 or higher, you may face severe DUI charges. On your first offense, you may face jail time of no less than 30 days with no probation and a fine of no less than $2,500.

In addition, the judge may order you to undergo alcohol education or treatment, along with community service. In cases of extreme DUI, your vehicles may require a certified ignition interlock device.

What is an aggravated DUI?

If you do not have a valid license, you may face aggravated DUI charges. Aggravated DUI occurs when you have a suspended, revoked or canceled license. Additionally, an aggravated DUI may happen if you commit a third DUI within 84 months, if you refuse to submit a BAC test or if you have a person under 15 in your vehicle.

Aggravated DUI charges have higher penalties, including prison for no more than two years and one-year license revocation.

In addition to typical DUI charges, you can also face additional penalties based on how many DUI offenses you have.
