Aside from underage drinking, the charge my office sees most from ASU students is possession of marijuana. Although states across the country are leaning closer to legalizing marijuana, if you don’t have a medical marijuana card, it is illegal to possess marijuana. Additionally, ASU can set it’s own guidelines for marijuana possession and consumption. As a government entity, ASU has every right to set standards higher than what is prescribed under the medical marijuana act. This means, despite having a medical marijuana card, ASU students are not allowed to consume or possess marijuana on campus.
As a student, you have to abide by ASU’s code of conduct. One of the codes is that you must not engage in criminal behavior either on or off campus. Because possession of marijuana is against the law, if caught you are breaking your code of conduct. While not all crimes will result in a code of conduct hearing, you can be assured that if you are caught possessing, smoking or ingesting marijuana on campus, you will absolutely have a code of conduct hearing.
ASU moves fast when scheduling hearings. You can expect to have your hearing within a week of your incident. Because you could be suspended or expelled, it is a good idea for a lawyer to go with you to ensure you are protected.
